Article 1 – Prices

1. Products sold with tresconfidentiel.com are exclusively intended for export from Morocco. Invoices are therefore issued VAT not included.
2. - tresconfidentiel.com prices are quoted in EUROS.
They are set into the product price excluding tax and transportation costs.
3. For Orders to countries other than Morocco, the Buyer is the importer of the concerned Products. For all Products shipped outside of Morocco, the price will be automatically calculated tax excluded in the invoice. Customs duties or other local taxes or import duties or state tax may be payable to the Buyer’s residence country. These duties and other taxes are not the responsibility of the Seller. They are on the burden and under the responsibility of the Buyer, in terms of disclosures and payments to the authorities or public departments in the Buyer’s residence country. It is advisable for the Buyer to obtain information from its related authorities prior any Order.
4. The Seller reserves its right to change prices at any time but the Products will be invoiced on the basis of the current applicable rates at the time of the Orders validation by the Buyer.
5. All products remain the property of the Seller until full price payment.

Article 2 – Order

1. Information on the Order form and Buyer’s mail statements:
   

   The Buyer who wishes to make an Order must fulfill  an electronic format Order and send it electronically to tresconfidentiel.com with reference to the instructions provided by the site and ensure that all requested information is printed without error.

   The Order form can be fulfilled in English, Spanish or French languages
   

   The Buyer shall disclose the information through such form as follows:

   • information provided by him in this form including information of the chosen payment mode, billing address and delivery information are deemed to be accurate;
   • the identity that it has disclosed in this form is in its capacity as the Buyer;
   • the card he uses to place his Order on tresconfidentiel.com is its ownership or he is specifically authorized by the owner to use it;
   • authorize the Seller to collect from third parties including the card issuer as shown in the Order form any information the Seller considers necessary for the identity of the Buyer and any authorization and verification necessary for the proper course of the Order’s payment of, and
   • accept the GTS, the quoted price and the description of the presented Products for purchase.

   The Seller reserves its right to carry out any checks on the information supplied to it by the Buyer. The data recorded by the Seller constitutes a proof of the nature, date and content of the contract.
   
   The aforesaid information will be transferred to institutions that provide related services to remote electronic payment, and to any other third party to verify this information, within the standards set out in the Seller Privacy Policy as indicated in a specific section on tresconfidentiel.com.
   
   The Seller guarantees the confidentiality of personal information the Buyer will provide when fulfilling its Order form (name, address, email, phone, etc.), together with those concerning the chosen payment mode. This information is stored in tresconfidentiel.com for a minimum of eighteen (18) months. Information regarding payment is backed up by PayPal or any other provider of electronic payment that is chosen by the Seller. The Seller has no access to the Buyer’s banking information.

   The Buyer has the option to obtain the history of its Orders by sending a request to the Seller at: customerservice@tresconfidentiel.com
   In the Order form will appear different products selected with the indication "add to cart".
   

   At any time, Buyer may:

   • Get an overview of Products it has selected by clicking "My Basket"
   • Continue its selection of Products by clicking on "Continue shopping"
   • Complete selection of its products and order products by clicking "Checkout"
2. Confirmation of Order:
   

   Any Order must be subject to confirmation from the Buyer. Orders are validated by the procedure of "double click".
   At the first Order and to prevent fraudulent use of credit card details, this above confirmation is subject to  the submission by email at customerservice@tresconfidentiel.com with a both sides copy of his official ID card and a domicile proof dated not less than 3 months.
   
   The Seller may need to ask the Buyer for more information including by phone. The Buyer is also requested to inform in the Order form the phone number relating to the correspondence address communicated to its financial institution from which its card is released.
   
   Upon receipt of the Order form and additional documentation to verify the identity and domicile of the Buyer, and no later than 48 hours, Seller will send to the Buyer by email a notice of receipt of the Order, containing a summary of information already contained in the Order form, including the GTS, the information concerning the essential characteristics of the Product, the detailed indication of the price, payment methods, the existence of the right of withdrawal of the Buyer,  time and delivery costs, and information relating to the servicing and contractual guarantees.
   The Seller shall not be required to justify the reason(s) for which it may not have confirmed the Order. The cases that may arise include the following:
   

   • Payment authorization has not been obtained,
   • The Product object of the Order is unavailable;
   • The Product object of the order requires specific customs and export clearances;
   • Several items of the same reference are ordered, and
   • The Buyer’s residence country is not serviced by DHL or by any other alternative carrier.
   It is also possible that the Seller is required to propose on tresconfidentiel.com items that have not yet been delivered to it by its suppliers.
   If the choice of the Buyer relates with one of these Products, it will have the choice to pay in advance the Seller in order to let it deliver under priority the Buyer, or to wait for the Product availability in stoc before the settlement. In this case, the Seller cannot guarantee its availability, the priority being given to Buyers having paid in advance.
    Where the Buyer decides to await for the availability of the Product prior to payment of applicable price, the Seller shall notify by sending an email to the address which has been referred to in the Order form.
   Where a Product been paid up an advance arrive in a defective condition, the Seller agrees to send the Buyer an email to notify it while reimbursing the payment within thirty (30) days from the date of sending such email.
   
   Where the presented Products on tresconfidentiel.com are no longer available or on sale at the time of latest  access to the site or when sending the order form by Buyer, the Seller agrees to inform as soon as possible after receipt of an order form the possible unavailability of ordered Products.
   
   In case where payment of the unavailable Order has already been transmitted, the Seller agrees to return to Buyer the amount of its concerned order no later than within thirty (30) days after its receipt.
   

   The available Products in the Buyer’s "shopping cart" cannot be booked and they can be purchased by other buyers.
   The contract is deemed concluded when the Seller sends Order confirmation specified in the Order form which will be sent electronically by the Buyer.
   The Buyer may access to its Order form when viewing seethefollowingofmyorder and keep track of the status of its delivery order.
   The Order form will be archived in the Seller’s database for a minimum of one (1) year.

   It is advisable for the Buyer to safe keep its email order confirmation or to printed it. However, legal stored documents will be considered as evidence in the Seller’s computer systems.

Article 4 - Availability

The Seller is a retailer and is not intend to sell in large quantities the offered Products. Consequently, the site does not authorize the order of more than one item of the same model and same size.

Products Offers by Seller are valid as they are visible on tresconfidentiel.com within the limits of available stocks off promotional operation. In the event of unavailability of a Product after Buyer’s Order, it will be informed by email. The Buyer's Order will automatically be canceled and no bank debit will be made. For information debit occurs once ordered product is shipped.

Article 5 - Delivery

1. Deadline:

   Once the contract is concluded, the Seller will take in charge the expedition of the Buyer’s order. The shipment delay is around 6 working days from the moment of the order confirmation by the Seller (applicable once payment has been validated).

   Shipment delays are indicated in the shipment section of tresconfidentiel.com.
   These delays can not be opposable to the Seller, but in case of unusual delay, an e-mail will be sent to the Buyer.
   The Seller is not responsible in case of shipment with important delay due to the postal services or the transporters in general. In no case, a delay of shipment can justify a cancelling of order or any compensation.

2. Delivery Cost:
   • Delivery costs are set out in section delivery tresconfidentiel.com subject the delivery country.
3. DHL deliveries conditions:
   •  DHL does not deliver to PO boxes or to general delivery;
   • DHL does not deliver on public holidays (see section holidays at delivery tresconfidentiel.com).
4. Who should receive the Order:
   • DHL makes deliveries every day of the week from Monday to Friday during working hours (9am-17h).
   • DHL can in no way set in advance the time of delivery.
   • DHL shall try to deliver the Order three consecutive times during working days. At each attempt, DHL shall leave a calling card with a telephone number where the Buyer can contact it.
   • After 3 attempts remained unanswered from the Buyer, DHL will bring the Order in its own store and contact the Buyer to arrange redelivery.
   • If DHL cannot make the Order delivery, it will return it to the Seller’ store.
     

   If the Buyer is entitled to receive Orders in its workplace, it is advisable to communicate the Seller with the corresponding address in the name of its employer, its business and whether a door opening code if required.

5. In case of customs clearance:

   Prior to sending an Order form, the Buyer is advised to check with its country customs authorities whether imports are subject to taxes and customs duties.

   If so, these taxes and duties shall be borne by itself and shall in no case be included in the Order price and freight costs that Buyer will pay to the Seller.

   Each time a delivery will be in a country whose imports are subject to customs duties and taxes, they will be invoiced by DHL or by an intermediary of the choice of the Buyer.

6. Country where there can be no delivery:

   DHL does not deliver the following countries: Iraq, Iran, Israel, Afghanistan and Sudan as updated from time to time

7. Delivery Delay:

    In the event that internal procedures for detecting fraud would require further verification, delivery time would be extended by twenty (20) working days in addition to the maximum period of 6 days as mentioned above.
   Seller agrees to promptly inform Buyer of such extended delivery time.
   The Seller shall not be liable for a delivery Order delay for which the issuer of payment card refuses to authorize payment.

8. Delivery follow-up:

   The Buyer may access to its Order form when entering seethefollowingofmyorder and keep track of the status of the delivery Order.

Article 6 - Transport insurance

The Seller is the underwriter of the insurance contract and thus it guarantees the purchases during transportation until delivery to the address specified in the Order by the Buyer. The latter will necessarily execute the delivery order the carrier designated by the Seller. From the moment the buyer has signed the delivery order, the product is no longer in the custody of the Seller and transport insurance will have no effect.

For the sake of the Buyers security, it is important to note that on the first purchase on tresconfidentiel.com cannot be delivered only to the person who will have ordered it as a Buyer within the meaning of the hereby  GTS.

Article 7 - Payment

The authorized payment modes and the related shipping costs are quoted in the Order form fulfilled by the Buyer.

The Buyer may pay by transfer order transmitted to its bank in order it transfers the payment from the Buyer account to the Seller one which will be reported in due course.

Payments can also be made online through PayPal.

To this end, the Seller has installed the link website PayPal payment standard on tresconfidentiel.com which allows payments either by opening an account on PayPal, or by providing information with regard the Buyer’s card payment of directly on the PayPal site.

A link from tresconfidentiel.com to the PayPal site will show the payment conditions, the securing payment and the cancellation policy.
Transactions on PayPal payments are subject to the PayPal terms and conditions (PayPal agreement for legal services). Seller is not responsible for the relationship PayPal has with the Buyer including when it comes to payment transactions of one or more Products of tresconfidentiel.com.

The PayPal authorized card payments are shown for information at tresconfidentiel.com’s"payment" page.  However it is recommended to visit PayPal which clearly indicates the authorized paymentmeans and conditions including cancellation therewith.

In case where other means of payment would come to be implemented, the Seller shall indicate it in the order form and it will update these GTS by integrating new authorized payment method.

Article 8 – Security

The means used to secure tresconfidentiel.com are the following:
The Seller will operate in compliance with the disclosed purposes, the personal data supplied by the Buyer under Orders, in accordance with Law 09-08 of February 18, 2009 on the protection of individuals with regard to the processing of personal data have provided a right of access and rectification or opposition on the personal data concerning it. The data will be completely encrypted and used exclusively to conduct transactions that Buyer has initiated (purchases or refunds in case of any refunds of products as stipulated in the article "return" of the hereby GTS) or in the case where it is necessary to notify the competent authorities when the occurrence of fraud on tresconfidentiel.com.
 
The Seller undertakes to the extent possible to implement all necessary precautions to protect Buyer’s data of namely those of the Order and those of payments which are protected by PayPal or by any electronic payment system used by the Seller. However, in the absence of negligence on the part of Seller, the latter  may not be held responsible for any loss the Buyer may suffer should a third person procures unauthorized or fraudulent access to data which shall be  communicated to the Seller gold during orders on  tresconfidentiel.com.

Article 9 – Withdrawal right and exchange

1. The Buyer is authorized to return a Product by requiring the Vendor within a maximum of seven (7) days from the time the Buyer has received a return number of this Product by email customerservice@tresconfidentiel.com.
   The deadline is thirty (30) days in the event the Buyer failed to discover the Product defect at the delivery date but discovered it later in a timely manner.
   Upon receipt of the return request from the Buyer, Seller will send an email to the Buyer indicating the number that the Seller has assigned it.
   It is understood that the exchange is permitted only with respect to Products such as clothing size that does not match with the Buyer’s one.
   In other cases, the exchange can take place only after a refund of the product to be returned concurrently with the filing of a new Order.
   If the Buyer wishes to make gifts, they can be delivered only to the Buyer’s address. Similarly the return on a gift can be made only through the Buyer.

2. non-compliant deliveries:

   Despite the care taken in the orders preparation, some Products may be defective order, missing or non-compliant.

   Therefore, on receipt of the Buyer's order, it is advisable to check the conformity of the received Products. Any anomaly concerning the delivery (missing, broken, non-conforming or damaged package) must imperatively be notified within seven (7) days of the package receipt at the Seller's Customer Service. Any claims made after this time will be rejected and the Seller shall be relieved from any liability.
   If the above conditions are met, the Buyer must return the Product in accordance with the return procedure set out in the hereby GTS. The Seller will then either refund the defective Product (s)  or return of the missing product (subject to the merits of the Buyer’s request). The refund Intervenes in the specified time in the article "reimbursement."

3. Procedure for a return:
    The Buyer shall do the following:
   
   • Send email to customerservice@tresconfidentiel.com within a maximum of seven (7) days from the date of its order receipt, a return form indicating where the return is for example an exchange of size together with the desired size;
   • Upon receipt of this email, Seller will send by email to the Buyer the return number as it has been assigned;
   • Immediately get in touch with DHL to arrange removal of the Product. In order to find DHL nearest agency contact to the Buyer’s address of the, he is invited to visit www.DHL.com and select the country of residence;
   • ful fill the invoice return to the goods (and the DHL bill transport if necessary) with reference to the return authorization number whichn given by the Seller and then proceed to its signature. Buyer is requested to leave the package open to allow the DHL employee in charge of removing the product controlling it.
   • Seller will notify receipt of Product by sending an email, and
   • The return costs are borne by the Buyer which will be paid direct to the DHL employee responsible to remove the Product to be returned at the return time.
   • By the DHL intermediation, the Buyer may return Products to Seller using pre-printed adhesive label attached to the package containing the products in order to enable the Seller to verify at any time where each package is located.
4. Seller’s conditions for accepting the return of goods:
   a. Return form must be  correctly fulfilled and sent to the Seller within seven (7) days after delivery of the Product
   b. return is arranged with DHL within a maximum of 14 days from the date of delivery of the Product
   c. Products on a single order must be returned at the same time in one shipment
   d. return must be made in the original packaging including boxes of shoes for example. In cases where a return is made in box shoes that have been damaged, it will not be accepted
   e. The Product should have not been worn, used, changed, washed, or damaged;
   f. the Product must be returned with all tags and authenticity card (including bags) if it had at the time of delivery, if on receipt of the Product Buyer's remark that he does no label must notify the Seller by email customerservice@tresconfidentiel.com
   g. All returned Products must include the authorization number returned that Seller has communicated. Products that cannot be identified by the Seller will be returned to the recipient.
   h. The lingerie and swimwear must be returned with the protective adhesive with which they were delivered;
   i. The shoes soles should not contain any trace of use (It is recommended for this purpose for example to try the shoes on a carpet)
   j. Products must be returned whole and not used in their sealed as originally
   Seller reserves the right to refuse a return if one or more of these conditions are not met or for any other reason at its discretion.
   

   Once the return of the Product will be accepted by the Seller, it will reimburse what is due to the Buyer within a maximum of thirty (30) days after acceptance by issuing an "appropriation bill" that will be transmitted by email.

   Return costs charged by DHL will be borne by the Buyer. The Buyer shall pay them in the hands of the DHL agent who will undertake the Product removal management for the return.

   Where the return is not accepted by the Seller, the Buyer may not claim neither a refund of amounts already paid to the Seller nor a credit on future purchases. It may however be asked to return the items at its own expense in the state in which it has returned to Seller. If Buyer does not wish the return of the Products, Seller shall be entitled to retain them with paid money by the Buyer care to purchase them.

Article 10 - Refund

Upon receipt of return, Seller will conduct such investigations as necessary.

If following outcome of these investigations it appears that the conditions for return have been met by the Buyer, Seller will forward the email acceptance confirmation of returned Products.

Whatever payment method is used, the Seller will reimburse within thirty (30) days from the date of acceptance notification of this return. The reimbursed amount will be the full price of returned Products as well as original shipping costs with the exception of taxes and customs duties that the Buyer might have settled for the importation of these Products, and any transaction fees that might have been charged by Paypal or by the Buyer's bank. The Buyer may possibly recover by directly contacting the local customs of its country of residence.

Return transportation charges invoiced by DHL will be borne by the Buyer and shall be paid by it directly to the DHL agent who will undertake the return removal products.
 
The refund can be made for the benefit of the person who has completed the purchase of the Product.
 

The refund of a returned item cannot be done by reimbursement. The assets are not allowed.

Article 11- Promotions

1. The Seller will have to take its best customers discounts.
   In this case, the Buyer finds his account in the reduction to which he may be entitled to the amount of its next purchase.
   It will also be notified by email of these reductions by passing the promotional code that the Seller has assigned to it.
   Promotional codes are custom code that can receive a discount on purchases made on tresconfidentiel.com.
   
   The TCC CODE field is located on the first page of the cart: once the items included in the "basket", the Buyer will insert the code in the "TCC CODE" and click "Update." A window pop-up will open and allow it to choose the products it wants to buy one it wishes to implement its reduction. This will require to select the Product and click "APPLY". Discounts are applicable to only one product per Order and therefore, other Products included in the basket will not be any discount.
   The reductions are not systematic and are offered at the Seller’s discretion
   

2. Limitations to the discounts use:
   a. The Products which have been discounted cannot be returned;
   b. The reduction will in no case be converted into cash;
   c. The application of the reduction will in no case relate to  an Order which  has been validated and paid
   d. The reduction application can be made where the code was entered correctly, and
   e. The reduction is granted at the Seller’s discretion (promotional campaigns, private balances...)
   f. The discount will be applied to one Product per Order;
   g. It is not possible to apply a reduction to the Products listed in the "promotions".
   

If for any reason the Buyer is not satisfied with his Order, he may make the article to which he applied the reduction following the procedure of "typical return. Once the return has been accepted, the initial reduction will reactivate the Buyer’s account. The difference has been paid to purchase the Product will be fully re-credited to the Buyer in the normal reimbursement.

Article 12 – Intellectual Property

All items tresconfidentiel.com, whether visual or audio, including the underlying technology, are protected by copyright, trademark or patent.

They are the exclusive property of the Seller. The user who has a personal website and who wishes to place, for personal use on his site a simple link pointing directly to the homepage tresconfidentiel.com must necessarily apply for written approval of the Seller

However, any tresconfidentiel.com hyperlink and using the framing or inline linking technique is strictly prohibited.

In any case, any link, even tacitly authorized, will be removed at the Seller’s request

Hyperlinks can refer to other sites that the tresconfidentiel.com. The Seller disclaims any liability in the case where the content of these sites violate the laws and regulations.

Products sold by Seller are sold to customers in strict conformity and compliance of intellectual property rights of inventors or manufacturers of those products from whom  it has obtained all authorizations for undertaking the marketing of their products through tresconfidentiel.com .

Article 13 – Privacy Policy

The Buyer may obtain information on how the Seller personal data trafficking process of the Buyer in reviewing the Privacy Policy section of tresconfidentiel.com
It is also recommended to read the Terms of Use because they contain important clues about how the data are processed personal users tresconfidentiel.com well as security systems adopted.

Article 14 - Applicable law - Disputes

The language of this contract is the French language.

In case of dispute, the applicable law and jurisdiction will be that of the Seller’s establishment. The Seller still has the power to seize any jurisdiction, in particular the place of delivery of Products.

Article 15 – Changes and updates

The GTS can be amended and in particular due to changes in laws. The new Conditions of Sale apply to their date of publication at tresconfidentiel.com. The amendments are passed after sending an Order by the Buyer will have no impact on this order unless they have been motivated by a law.

It is therefore recommended to regularly read the terms and conditions governing tresconfidentiel.com before your order.

If Buyer does not accept any amendments of these GTS, he should immediately stop using tresconfidentiel.com.

These conditions and any modifications thereto shall apply throughout the duration of the on-line offered products on tresconfidentiel.com.

Article 16 – Guarantees

1. Information Products:
   For each Product sold on the tresconfidentiel.com, the Seller agrees to provide a description to present the essential features within the information provided by suppliers. Seller will make every effort to provide Buyer with a maximum of information enabling it to know the Products before recording its orders.
   The Seller may also respond by email to any questions sent to it by Buyer at info@tresconfidentiel.com regarding any Product featured on tresconfidentiel.com
   Despite all the care taken in writing these descriptions, errors may occur. If the Buyer finds an inconsistency, it may contact Customer Service to inform at customerservice@tresconfidentiel.com. Seller undertakes to proceed as quickly as possible to correct these errors.
   Photographs and descriptions of products are not contractual and Seller shall in no circumstances be held liable for any errors that may exist.
   In particular, images and colors of displayed products on tresconfidentiel.com may not be exactly similar to the true Products color under the effect of used Internet browser and the resolution of the screen display.
   Products on sale are first quality and authentic having been purchased directly by the Seller from licensed professionals suppliers for this purpose.

2. Warranties on Products:
   Guarantees for sold Products are included in the listing. Buyer with a defective item which the guarantee is still applicable, must contact the Seller's Customer Service who will forward the procedures to follow to obtain a repair, replacement or refund. Customer Service will ask the Buyer to contact the Seller’s supplier. Seller will make its best efforts to provide the coordinates of the after sale provider.
   In any case the Buyer may request an extension of the warranty applicable to a sold Product.
   

   In some cases, the Vendor acts as the suppliers’ agent. These ensure that the products sold are top quality and are shipped in good condition and show no defect or hidden defects making the Products unfit for normal use. Any guarantee can only be valid in case of defects, damage from external events, improper installation or use not consistent with the supplier.

Article 17 – Liability

The Seller's liability is limited to the amount of the Buyer’s Order.

This responsibility cannot be held liable for any inconvenience or damage arising from the use of a computer, computer network or Internet. Notably, the Seller shall in no way be held liable for breach of service, external intrusion or presence of a computer virus. It is only responsible for all way access stages has tresconfidentiel.com, including consultation, information form, ordering, payment and other services available on tresconfidentiel.com.

Seller shall not be held responsible for any tangible or intangible damage caused by the malfunction or misuse of any purchased Product on tresconfidentiel.com.
It belongs to the Buyer to check with local authorities about the specific taxes, declarations, prohibitions, opportunities to import or use of ordered Products. The Seller's liability can be incurred for non-compliance in the country where the Products are delivered.

Article 18 – Force majeure

Seller is not responsible for the failure to perform all or part of its obligations under this contract, if such non-performance is caused by an event of force majeure, including in cases of disruption or total or partial strike especially postal services and transport and / or communications, flood, fire.

Force majeure events will be considered fulfilling the criteria set by the applicable law and case law of the Supreme Court.
In the presence of an event of force majeure, the Seller will notify the Buyers and users of tresconfidentiel.com within five (5) business days following the occurrence or threat of such an event.
The Parties agree that they should consult as soon as possible to determine all the modalities for performing the Order for the duration of force majeure.

Beyond a period of one (1) month break due to force majeure, the Seller is no longer able to fulfill the Order, on condition that it reimburses the Buyer if any.

Article 19 – Entire agreement

In the event that any provision of this contract is annulled or declared illegal, such invalidity would not affect the other clauses of the contract or the validity of the GTS nor other conditions of this contract.

Article 20 - Customer Service

Any information the Buyer may request is by hotline contact or by e-mail to info@tresconfidentiel.com. For more information, it will have to go to the Customer Service area.
